Found this on Slashdot, it's getting no coverage in mainstream media right now, other than a AP wire report. Not that that is too supprising.

Apparantly, the Arizona Libertarian Party sued Arizona State University, the host of the next presidential debate, to allow their candidate to be in the debate. The Greens, are, of course, supporting this as well. The basis is that the state of Arizona is spending over $2 million of tax payers money to host the debate, which includes payments to the Commission on Presidential Debates, which they allege is partisan in that the CPD wouldn't allow third party candidates in the debates.

An Arizona judge ordered ASU and CPD to appear in court, and Libertarian Party candidate Michael Badnark and Green Party candidate David Cobb tried to serve the papers to CPD at the St. Louis debate. They were arrested there by the St. Louis police for trying to break through the police line surrounding the building where the debate was going to take place.
