I just browsed back over at RSC and found that there was a new forum. It says that the man that co-founded Papy, Dave Kaemmer bought back the source he made for GPL and N2003 and together with a person famous from the Red Sox is making a new race-sim.

Could this be true?

Yes Dave has bought the rights to the source from Sierra and is in the process of developing a new game. At last they will be free from the influence of Sierra which dictated what games they made :D
I can't wait.

It's a bumper year for race-sims, and a few in particular will be free of their previous publisher related shackles..
This First Racing had better support proper mods, or it will be left behind by ISI's rFactor, a game in which they are planning to do what they really want to do, and they plan to make it mod-able like never before.

This DK guy isn't only making his own sim.. He's being quite militant about it. Some guy is now on the receiving end of legal action from the First lot.
Don't blast First though. They are only protecting their property. And the other party should really know better. EULA's strictly dictate that reverse engineering is not allowed. When the EULA says that, any sort of reverse engineering is going to be dodgy from a legal point of view.
And that surely must include mods for the game in question.

alot of people are refusing to touch his new game, or nsr, for fear of being sued...i personally won't touch this guy's new game if he's going to sue for adding a new car to it or something of the like...personally i think it's a load of crap

That's why I'm supporting games that openly support the efforts of the mod community. That means rFactor, and MS Flight Simulator 2004.
For FS2004, MS provides all the dev-tools and help you'll need to get started with making new planes for FS2004. It isn't easy though, and the standards of the bigger freeware developers will leave you in shock.

Yes I read that recently. I understand protecting proporty and as I understood it one of the mods were reprogramming the exe to modify the physics and that's beyond what I call an acceptable mod. I also understand it there was a mod with Group C cars that was halted, although now re-released with some special permission, does that mean it was DK that sued and not the carmakers or sponsors of the cars?
And now the important question: When will rFactor be out and how on earth can people already be modding it when only a mp test-game is released?
